What has the new clause in the CV changed after the entry of GDPR?

In 2018, our e-mail boxes were flooded with information about the GDPR. Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46 / EC (general regulation on data protection) it entered into force in 2016, while it began to be used on May 25, 2018. Entrepreneurs had to adapt the operation of their companies to this document – monstratext. One of the changes that is definitely worth mentioning is the new clause in the CV. What is its current wording? We suggest in the article!

Clause in CV – where to put and why?

Anyone who participated in at least one recruitment and prepared for its application documents, knows that companies in their advertisements often ask for a clause in which we consent to the processing of our data. However, it is always worth posting it, even if there is no explicit request from the employer. Why is this so?

What data of a candidate for a job may be processed by a potential employer is regulated in the Labor Code. According to it, these data are:

These data may be processed whether or not they include the clause. However, as you can see, we provide more information in the CV – for example about our skills or interests. Some people even add a note about their marital status on this type of documents, it is very common to insert a current photograph. Therefore, a new clause in the CV that allows the processing of data is necessary.

That’s not all. By including the clause in the CV, we agree to the processing of our data ONLY during this one specific recruitment. Therefore, if we want to be taken into account during future recruitments, for other positions or simply for the next search for a person for the one we are currently interested in – we must mention it in the clause. If we don’t, even if we are the perfect candidate, the recruiter will not contact us.

Therefore, we should include a clause in our CV every time we create a document. It’s best to put it in a footer – then it won’t take up too much space and will still be legible and separate from the rest of your CV.

New clause in your CV

We now know why the clause is so important when creating a resume and why it should not be omitted. However, you should be aware that it may expire. And so the content is probably known to many of us:

I consent to the processing of my personal data for the needs of the recruitment process (in accordance with the Act of August 29, 1997 on the protection of personal data Journal of Laws No. 133, item 883, as amended).

is no longer available. So what is the new clause in your CV? When to opt for two consents in our document?

The new clause in the CV reads as follows:

I consent to the processing of my personal data for the purposes of necessary for the recruitment process (in accordance with the Act of May 10, 2018 on the protection of personal data (Journal of Laws of 2018, item 1000) and in accordance with the Regulation of the European Parliament and of the Council (EU) 2016/679 of April 27, 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46 / EC (GDPR)).

The clause may also include the name of the company which we allow for the processing of our data.

I consent to the processing of my personal data by COMPANY NAME for the purposes necessary for the implementation the recruitment process…

A shorter form of the clause, which only mentions the GDPR, is also acceptable. Then it may read as follows:

I consent to the processing of my personal data for the purposes of recruitment (in accordance with Article 6 (1) (a) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46 / EC (General Data Protection Regulation)).

As already mentioned, if we want our CV not to be one-time for the company or recruiters, it is also worth adding another, short clause that will allow them to use our data again. It may read as follows:

I consent to the processing of my personal data in the field of future recruitment processes.

In the above clause you can also indicate which we give consent to the company. If, however, we want to combine both clauses, we can do so, in which case a new clause in the CV is:

I consent to the processing of my personal data for the purposes necessary for implementation of this process and future recruitment (in accordance with the Act of May 10, 2018 on the protection of personal data (Journal of Laws of 2018, item 1000) and in accordance with the Regulation of the European Parliament and of the Council (EU) 2016/679 of April 27, 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46 / EC (GDPR)).
